Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of the FindingLeads websites, applications, dashboard, and related services (together, the “Service”). By creating an account, claiming an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The service

FindingLeads is an AI lead desk for home-service professionals. We help you catch missed calls, respond to new leads quickly, follow up until a job is booked, publish a Pro Site, and manage the leads and messages that come through the platform. Features, plans, and integrations may change, improve, or be discontinued over time.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for everything that happens under your account, and for keeping your login credentials secure. You agree to provide accurate information (including business, trade, service-area, and any license details) and to keep it current. Notify us promptly at hello@findingleads.com if you believe your account has been compromised.

3. Plans, billing, and cancellation

Paid plans are billed in advance on a recurring basis (monthly or as otherwise stated at checkout) through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method for the plan you select, including applicable taxes, until you cancel.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from your dashboard or by emailing hello@findingleads.com; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods, unused features, or plan downgrades. We may change plan pricing or features on prospective notice, effective at your next renewal.

4. Leads and results

FindingLeads provides tools to capture, route, and follow up on leads. We do not guarantee any specific number of leads, quality of leads, response rates, bookings, revenue, or business results. Leads may come from your own missed calls, website forms, integrations, and demand partners such as LocalHelpNow; the decision to contact, quote, or serve any lead, and compliance with all laws applicable to your business, is yours alone.

5. Pro Sites

If you use a Pro Site, you are responsible for the accuracy of the business information, licensing, imagery, and claims it displays, and for ensuring your content and offers comply with applicable law and advertising rules. We host and render the Pro Site; you grant us the license described in Section 7 to do so.

6. Acceptable use

You agree not to:

• use the Service to send unlawful, deceptive, harassing, or unsolicited messages, or to violate any anti-spam, telemarketing, TCPA, or messaging law or carrier requirement;
• contact leads without a lawful basis, or after they have opted out or asked you to stop;
• infringe anyone’s intellectual property, privacy, or other rights;
• attempt to access, disrupt, reverse engineer, scrape, or overload the Service or its infrastructure; or
• resell, sublicense, or misrepresent the Service, or use it to build a competing product.

7. Your content and license

You retain ownership of the content and data you submit (your business information, Pro Site content, and lead and message content). You grant FindingLeads a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and adapt that content solely to operate, secure, support, and improve the Service. You represent that you have the rights needed to grant this license and to share the information you provide.

8. Text messaging (SMS) program

FindingLeads Lead Alerts sends text messages to home-service professionals who create or claim a FindingLeads account. Messages include new-lead notifications, replies related to leads you are working, sign-in links, and service updates about your account.

You opt in by providing your mobile number during signup or account claim and agreeing to receive texts. Consent to receive texts is not a condition of any purchase. Message frequency varies with your lead activity. Message and data rates may apply.

Reply STOP to cancel at any time. Reply HELP for help. After you reply STOP we send one final message confirming your opt-out and then stop texting you. You can also reach us at hello@findingleads.com. Carriers are not liable for delayed or undelivered messages. How we handle mobile information, including our commitment not to share mobile numbers or SMS consent with third parties for marketing, is described in our Privacy Policy.

9. Third-party services

The Service integrates with third parties (for example Stripe for payments, messaging and email providers, analytics, and tools you connect such as your CRM or scheduling software). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

10. Intellectual property

The Service, including its software, design, and the FindingLeads name and marks, is owned by NameNiche LLC and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your business while these Terms are in effect. No other rights are granted.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any lead or message will be delivered.

12. Limitation of liability

To the fullest extent permitted by law, FindingLeads and NameNiche LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless FindingLeads and NameNiche LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, your messaging to leads, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms, if required to protect the Service or other users, or if you fail to pay. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

15. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the state in which NameNiche LLC is organized, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in that state have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue there.
